Goshen - An Orange County jury awarded a young boy significant compensation for serious injuries he suffered to his left hand when he tripped over a box left on the floor at a local service station. A jury sided with Jacob McLachlan, of Circleville, awarding compensation for both past and future pain and suffering. Jacob was ten years old when he tripped over the box on April 18, 2004. He had just taken a glass soda bottle from a cooler, when he tripped over the box left behind the cooler. The bottle shattered, stabbing the boy's left hand, severing a tendon. Reattachment surgery was performed, but Jacob, now 13, still has permanent weakness in his dominant left hand, along with tingling and numbness. The insurance company claimed the accident was the result of the boy not paying attention. "Jacob was paying attention just as any of us would have: by looking straight ahead", said trial attorney Gregory Sobo. "I think the jury believed that the box was a tripping hazard to both children and adults." The jury found the service station 100 percent responsible for causing the fall. "The jury understood that this injury will affect Jacob for the rest of his life", said Sobo. "So it makes sense that the mount awarded will also affect Jacob in the future, but in a positive way." The store has indicated a possible desire to appeal the verdict as excessive.
