GOSHEN, NY - it is an age-old question: Who is responsible for clearing ice and snow from sidewalks in front of a business? An Orange County Supreme Court jury recently determined that it was the business owner and not the village that should have maintained a safe condition. Since the jury's decision was reported, businesses began to take notice by making their sidewalks safer. The plaintiff, Judy Studwell slipped and fell on ice as she left a local tavern early in the morning of January 25, 2001, resulting in a fracture to her right ankle that required two surgeries, with insertion of a plate and eight screws to bold her ankle tack together. The jury found the tavern 100 percent liable for other injury and awarded Mrs. Studwell $540,000. "This is a landmark verdict for a case such as this, in Orange County", said Gregory Sobo, who represented Mrs. Studwell. "This jury verdict should send a message to every business owner, regardless of their location." 22 NYCRR 1200.1 requirement:
