Fatal accident in New York leaves one motorcyclist dead

Tragedy struck on a highway on May 5 when a motorcyclist collided with a car, resulting in the cyclist’s death. The fatal accident took place in the afternoon and an investigation is ongoing by local and New York State Police. Authorities have turned to witnesses for additional information about the crash.

Preliminary reports suggest the motorcycle, driven by a 34-year-old out-of-state man, was traveling north when he collided with an SUV driven by a 38-year-old New York resident. The resulting crash threw the cyclist from his vehicle. He suffered severe injuries and was pronounced dead at the scene by a local medical examiner.

The driver of the SUV suffered minor injuries related to the deployment of his air bag during the crash. He was examined at the scene by emergency medical personnel who declared him largely unharmed. Police have impounded both the motorcycle and the SUV pending further investigation into the crash. There is no word whether charges have been filed or if the driver of the SUV is in custody.

The investigation into this fatal accident will likely take time and rely partly upon witness statements to determine how the crash took place. Should the driver of the SUV be found in any way negligent for the accident, the fact that the other man was killed in the crash may pave the way for a potential wrongful death suit should the motorcycle driver’s next-of-kin desire it. New York traffic law demands a degree of care from cyclists and drivers alike, and an understanding of the responsibilities of both parties may be necessary should further legal action be undertaken.
