A horrifying tragedy in western New York has left a family torn asunder. The fatal accident involved an out-of-control bus that struck and killed an 8-month old child off a New York street. Police are still investigating the cause of the crash, and no charges have yet been filed in this terrible incident.
Police reports indicate the bus dropped off several passengers before returning to the road, when it suddenly accelerated out of control and left the street. The bus struck a lamp post which in turn fell onto a baby carriage before striking a second lamp post, a tree and a series of parked cars. Law enforcement officers arriving on the scene tried to resuscitate the infant but failed. The child was pronounced dead on the scene.
Multiple other people were injured in the crash, including several who were in the parked cars at the time of the accident and the bus driver himself. He is currently in medical care under police guard at a local hospital. Although the investigation is still underway, police have reason to believe a combination of unsafe speed and driver inattention may have been the cause of the crash.
The death of a child is an unspeakable tragedy, particularly in cases in which the fatal accident could have been avoided. Should police find the bus driver guilty of reckless driving, he will likely face criminal charges. However, the family is also entitled under New York law to file a wrongful death law suit against the driver in civil court, which would happen separately from any criminal charges that may be filed.
