Boy dies in fatal accident in New York after being hit by van

One of a parent’s worst fears is hearing that his or her child has been killed in an accident. Perhaps what is worse than hearing such news is seeing the frightening scene unfold before one’s eyes. One mother recently faced this fatal accident situation in New York, which cost her the life of her 5-year-old son.

The accident occurred in Brooklyn when a minivan was traveling on a road. A 5-year-old boy was walking with his mom after they had just left their home. He suddenly ran away from his mother.

The boy ended up in the street, where the van struck him while it was backing up. The driver of the van left the scene but then returned, saying that she did not realize she had struck anyone. The boy was transported to the hospital and later died there. The minivan driver, a 23-year-old woman, faces charges of leaving an accident scene as well as violating a red light and reckless driving.

The woman will now have to respond to her criminal charges. The family of the deceased boy also might decide to file a wrongful death claim against her in New York. Financial restitution from a victoriously navigated claim can help the family to pay for funeral costs as well as address emotional distress and pain and suffering. If the driver is convicted of the charges she faces, evidence of this may be presented in an effort to prove her financial responsibility for the death caused by the fatal accident.
