An unspeakable tragedy has befallen a family following a devastating car accident in Virgil, according to local sources. New York police have reported that the fatal accident took the life of a child of indeterminate age. Several other people, including more children, were injured in the crash. Police arrested the driver, who now faces several charges including aggravated DWI pursuant to Leandra’s Law.
Details of the crash are sketchy at best, but New York police have reported the man was speeding around 8:45 p.m. on April 24 when the accident occurred. He subsequently lost control of his vehicle, which crashed into a utility pole. The vehicle carrying the 29-year-old man was also transporting five other people, three of whom were children.
The status of the adult passengers is unknown at this time, but it has been confirmed that all three children, ages 6 to 10, were injured in the crash. One of those three children, who has not yet been identified, was later pronounced dead. The man currently faces charges including reckless endangerment and aggravated vehicular homicide in addition to the standing DWI charge. He will face trial in short order.
In addition to the criminal charges filed against him, New York law will allow the family of the child killed in the fatal accident as well as the families of the other injured parties to file civil suits against the driver. These suits would be handled in a civil court setting, irrespective of any criminal proceedings occurring concurrently. However, any evidence brought forth in the criminal trial can be repurposed for civil court to help prove the guilt of the driver in question.
