10-month old tragically dies in car accident in New York

A serious crash in Kinderhook has resulted in the tragic death of a 10-month-old child, according to local sources. New York authorities are still trying to piece together the cause of the crash on Route 9 in the early evening of Nov. 2. It appears from a preliminary investigation that one of the two drivers involved in the car accident may have entered the wrong lane, precipitating the crash. 

Reports have indicated that a 33-year-old man traveling south on Route 9 may have veered into the oncoming lane around 5:20 p.m. on the evening in question. In the meantime, an SUV traveling northbound that was driven by a 34-year-old woman was struck head-on by the other man’s vehicle. Four passengers in the SUV sustained serious injuries that were not considered life threatening at the time of this report. 

Unfortunately, a 10-month-old child in the back seat of the SUV was seriously injured and pronounced dead. At the moment, the crash remains under investigation, and no charges have yet been filed against the driver believed to be responsible for the accident. State police are assisting the local district attorney’s office in the investigation. 

If it is determined that the southbound driver was guilty of negligence, recklessness or even intoxication at the time of the car accident, he could face serious criminal charges. New York law also states that the family of the deceased infant, as well as those injured in the crash, are entitled to file wrongful death and personal injury suits against him. Even if he is not convicted of a crime, he could be responsible for damages against the individuals involved in the crash.
