Fatal accident leaves woman passeger dead in New York

A passenger is dead and the driver of the vehicle has been charged, according to police from the 94th precinct. New York authorities charged a 27-year-old Brooklyn man with negligent homicide and DWI following a fatal accident that claimed the life of his passenger. Police say their investigation is still underway. 

According to the accident report, the man was apparently driving at a high rate of speed while under the influence of drugs when he crashed into a tractor trailer that was in the process of leaving a parking lot around 6 a.m. the morning of Dec. 23. His passenger, a 26-year-old woman, was seriously injured in the crash, suffering severe head trauma. She was rushed to a local hospital, where she was later declared dead.

The driver suffered minor injuries in the crash and was taken into custody by officers on the scene who suspected him of being intoxicated. He now stands charged with vehicular manslaughter, speeding, negligent homicide and DWI. The driver of the tractor trailer apparently remained at the scene of the accident and cooperated with police. He was not injured. 

The New York Police Department investigation into this fatal accident is still ongoing at this time, and it is as yet unclear whether additional charges will be pursued against the man. In addition, the family of the deceased passenger will be entitled under state law to pursue wrongful death litigation in civil court. Such a claim would require evidence that the man was negligent in a way that caused or substantially contributed to the fatal accident.
