Man arrested for DUI after New York car accident

A man is in custody following a serious accident police believe was caused by intoxication. New York police arrested the Queens man for DUI as well as manslaughter after a car accident that caused the death of another man. For the moment, police are still investigating the tragedy, and no court date has been announced. 

According to the accident report, the 36-year-old man was drunk when his vehicle entered an HOV lane on the Long Island Expressway. His car struck a man who had exited his vehicle in the HOV lane to conduct repairs on his bumper. The victim, who has not been publicly identified by police, was pronounced dead at the scene. 

The accused man was arrested on the scene. He was taken to a local hospital with undisclosed injuries. Police say they intend to arraign the man as soon as he is medically able to attend court. He will face manslaughter and driving while intoxicated charges. 

If he is convicted of either of these charges, he could face serious jail time under New York criminal law. Separately, the surviving family of the fatal car accident victim are also entitled to file a wrongful death lawsuit against the driver, which do not require a criminal conviction in order to be filed or litigated in civil court. However, whatever evidence police are using to prove the man’s intoxication in criminal court (a blood test or Breathalyzer test are the most likely) can also be offered to support the civil claims for monetary damages as well.
