Toddler injured in New York car accident

A 5-year-old boy is in critical condition following a serious accident in Queens. New York authorities have reported that an MTA bus was rear-ended by a personal vehicle, resulting in the injured child. So far, no charges have been filed in connection with the tragic car accident

Police have reported that an MTA bus was parked at a bus stop around 1:50 p.m. on the afternoon of Aug. 21 when the accident happened. A vehicle driven by an unidentified person reportedly rear-ended the bus with enough force to throw the 5-year-old child out of his seat. It is unclear at this time whether the child was properly restrained at the time of the impact.

The child was rushed to a local hospital with neck and head injuries, and he was described as being in critical condition. The driver of the car reportedly exited the vehicle under her own power but was taken to a local hospital by arriving EMS personnel. She is believed to be in serious condition. The bus was unoccupied at the time of the crash as it was out of service.

More information may be required for New York authorities to determine whether they will file criminal charges against the female driver of the car involved in this car accident. Even if they do not, however, the family of the injured child will be entitled to file a personal injury lawsuit against her. It is unclear whether the woman and the child are related, but familial relation does not necessarily discount the potential for a personal injury claim to be filed in civil court.
