A man is dead and his passenger seriously hurt following a serious single-vehicle accident near Martin Luther King Jr. Park in Buffalo. New York authorities responded to the car accident that claimed the life of a 50-year-old man and sent another man to the hospital. So far, they have not ascertained what caused the crash, but they are continuing to investigate as of this report.
The report says that sometime around midnight, the driver of the vehicle somehow lost control, causing his car to leave the road. The car struck a utility pole and then a tree, causing serious damage to the car. The driver was pronounced dead at the scene of the crash. An unidentified male passenger was transported to a local hospital for treatment, where his condition is described as serious.
Police are unsure at this time what predicated the accident. They believe the vehicle was traveling at a high rate of speed at the time of the collision, but they have not commented publicly on why that might have been the case. They have not commented on whether they believe alcohol, recklessness or negligence were factors in the crash.
While no criminal investigation will be launched as the driver perished in the car accident, New York authorities will still work to determine what happened. If it turns out the driver contributed materially to the crash either by way of negligence or recklessness, it may be possible for the passenger to sue for personal injury. Appropriate evidence of the driver’s negligence would be necessary if damages were to be awarded by the court.
